The pre-action protocol is formally adopted

The introduction of the CPR and the concept of pre-action protocols set the scene for the first edition of the Dilapidations Protocol. This first edition of the Dilapidations Protocol was introduced by the PLA in 2002 and RICS quickly endorsed it as best practice. An updated version was issued in 2006 and was replaced by a new draft in May 2008. In 2009, the protocol was passed to the CJC, which in turn recommended its adoption to the Master of the Rolls. Since 2009, the PLA and RICS have been liaising with the CJC and the Rules Committee about the precise wording of the protocol.

The protocol has now been formally adopted under the CPR and came into force on 1st January 2012.  It is a lot shorter than earlier versions and a number of changes have been made to make it easier to use and understand.

Anyone working in the dilapidations sector should familiarise themselves with the new protocol and make sure they understand the changes and their implications.

Dilaps UK co-host a Dilapidations Seminar in conjunction with Property Week

Dilaps UK played host to around 100 property sector guests for a masterclass on The Business Approach to Dilapidations. The event was co-hosted with Property Week, Wilberforce Chambers and Mishcon de Reya. The subject of dilapidations is increasingly a flashpoint between landlords and tenants, and the unusual market conditions call for a new and more business-like approach. With reference to a modern case study, our panel highlighted valuable tools which enable landlords and tenants to reduce the time and costs involved in resolving these dilapidations disputes.

Our panel chaired by Giles Barrie, Editor of Property Week, included:

Dilaps UK donates the proceeds of its new dilapidations lease clause to Great Ormond Street Hospital

Following the popularity of the new Dilaps UK dilapidations lease clause and the successful downloads Paul Lande recently donated the proceeds to Great Ormond Street Hospital.  The attached photo shows Paul Lande presenting the cheque to the Children’s hospital and the funds will go towards the large scale re-development of the building.  Also available to view is the letter of thanks received from Great Ormond Street Hospital.

Dilapidations Arbitration Clause for Commercial Leases

In tandem with the launch of the scheme, Dilaps UK and Thomas Eggar LLP, have now made available our draft Arbitration clause to cover dilapidations disputes. We believe landlords and tenants will want to include this clause in all their commercial leases granted in the future.

The clause provides for dilapidations disputes to be dealt with in an expeditious way without having to involve the Courts. Any areas of dispute can be dealt with by a specialist in this area acting as an expert or arbitrator depending on the circumstances. Legal issues can be dealt with by obtaining advice from an assessor where appropriate.
